Terms and conditions

These terms apply when you book a tour through www.touristurkey.com. Please read the section on who you are contracting with — it is short, and it matters.

1. Who you are contracting with

TourisTurkey is the brand you book under. Tours are sold and operated by TURAN NAZGUL KALEKE TURİZM, a travel agency licensed by the Turkish Ministry of Culture and Tourism under group A licence number 16585.

The contract for your tour is between you and the licensed agency named above. We say this plainly because you are entitled to know who is legally responsible for the service before you pay for it.

2. Booking and confirmation

Your booking is confirmed the moment you complete it — we do not hold requests for later approval. You receive a confirmation with a booking reference, the meeting point and the departure time, by email and on WhatsApp.

If you have not received a confirmation, you do not have a booking. Contact us rather than assuming it went through.

3. Prices and what they include

Prices are shown in euro and include all taxes. What is included and excluded is listed on each tour page and forms part of these terms. Prices can change, but the price confirmed in your booking is the price you pay.

Charters are priced per hour with a minimum booking length. Shared cruises are priced per person. Children and infants are charged at the rates shown on the tour page.

4. Payment

• Pay on board — nothing is charged when you book. You pay in cash or by card when you arrive, and no card details are taken at any point in the booking.
• We do not currently offer online prepayment, and we never ask for card or bank details by message. Any request to transfer money in advance is not from us.

5. Cancellation and changes

Cancellation deadlines, refunds and weather cancellations are set out in our cancellation policy, which forms part of these terms.

6. Safety and the captain’s authority

The captain is responsible for the safety of everyone on board and has final authority on whether, when and where the boat sails. The captain may shorten, reroute or cancel a trip for safety reasons, and may refuse boarding to anyone who is intoxicated, behaving dangerously, or refusing safety instructions. Refused boarding on these grounds is treated as a no-show.

Children must be supervised by an adult at all times. Swimming from the boat is only permitted where and when the crew says it is safe.

7. Our fleet and partner operators

Tours are delivered on boats we operate directly and on boats operated by partners we work with regularly. In either case your booking, your contract and your point of contact are with us, and the service standard is ours to answer for.

8. Your belongings

Please keep your belongings with you. We are not responsible for items lost or damaged on board except where the loss results from our own fault or negligence — nothing in these terms removes liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence.

9. Photography

We sometimes take photographs on board. If we want to use a photograph that identifies you in our marketing, we ask you first. Tell the crew if you would rather not be photographed and that is the end of it.

10. Complaints

Tell us during the trip if something is wrong — most problems can be fixed on the spot, and almost none can be fixed a week later. If you are still unhappy afterwards, email info@touristurkey.com and we will respond in writing.

Turkish consumers may also apply to the consumer arbitration committees (Tüketici Hakem Heyeti) or consumer courts. These terms do not affect statutory rights you have under mandatory consumer law in your country of residence.

11. Governing law

These terms are governed by Turkish law. This does not deprive a consumer of the protection of mandatory provisions of the law of their country of habitual residence.
